Overview
Ian Neil SC is a distinguished barrister who was admitted as a Legal Practitioner in 1985, called to the Bar in 1991, and elevated to Silk in 2006. He is a leader of the Bar in the fields of employment and industrial law, and work health and safety. He appears regularly in the High Court, the Federal Court, the Fair Work Commission, and in State Supreme Courts. He has been listed by Chambers and Partners in Band One in Employment for the last 10 years. He has been involved as counsel in many of the most significant recent cases in this area, such as leading authorities on issues such as casual employment (WorkPac Pty Ltd v Rossato), the approval of enterprise agreements (One Key Workforce Pty Ltd v CFMEU), redundancy and the ordinary and customary turnover of labour (CEPU v Delta FM Australia Pty Ltd, Berkeley Challenge Pty Ltd v United Voice, and Compass Groups Healthcare Hospitality Services Pty Ltd v United Workers Union), general protections (BHP Coal Pty Ltd v CFMEU and Lattouf v ABC), intractable bargaining (Svitzer Australia Pty Ltd v CFMMEU), and the interpretation of awards and enterprise agreements (Australian and International Pilots Association v Qantas Airways Ltd) . He has a deep knowledge of, and experience in, the coal mining industry, having appeared in dozens of cases for employers in BHP Billiton Group, and in the labour hire industry He is the author of The Modern Contract of Employment (3rd Edition), the leading Australian text on the law of employment law.
